Privacy notice pursuant to art. 13 of Legislative Decree 196/03 and EU Regulation no. 679/2016
Pursuant to art.13 of Legislative Decree 196/03 and following the coming into effect of EU Regulation no. 679/2016 in compliance with the provisions of art. 13 of the aforementioned European Regulation, we would like to inform you of the following:
Purpose of data processing:
Your personal data, freely communicated and acquired by us in connection with the business activity carried out by LISAM s.r.l., will be processed in a lawful and correct manner for the following purposes: sole administrative, accounting, commercial and marketing purposes (for promotional purposes only, without performing any customer profiling activity, so called "targeted marketing").
The processed data (of a purely common nature), may also be of a judicial nature (in the event of disputes, only if they can be traced back to acts entered in the criminal records) and are updated, relevant, complete and not excessive in relation to the above-indicated purposes for which they are gathered and subsequently processed. In this regard, you are reminded that the term "judicial data" means: "personal data suitable for revealing provisions referred to in art. 3 sub-section 1 letters from a) to o) and from r) to u), of Presidential Decree 313/2002, on the subject of criminal records, register of administrative sanctions dependent on crime and relative pending charges, or the status of defendant or suspect pursuant to articles 60 and 61 of the Italian Code of Criminal Procedure.
Personal data of a sensitive nature are not processed.
The data will be processed in a secure and confidential way using the following methods: gathering of data from the data subject, gathered and recorded for specific, explicit and legitimate purposes and used in further processing operations in terms compatible with such purposes, such processing carried out with and without the aid of electronic and automated media, storage of data in a form that allows identification of the data subject for a period of time not exceeding that necessary for the purposes for which they were gathered or subsequently processed.
Legal basis of data processing:
The legal basis for the processing of your personal data is based on an agreement signed between the parties or order validated by order accepted and signed by the customer.
Legitimate interests pursued by the Data Controller:
The legitimate interests pursued by the Data Controller in the processing of data are the result of the need to respect and abide by the contractual obligations entered into between the parties or the purpose of the requested order, accepted and signed by the customer. Pursuant to art. 6 the lawfulness of processing is based on the manifestly expressed consent of the data subject, documented in writing.
Mandatory or optional nature of the provision of data and consequences of a refusal to provide data:
The nature of the provision of data by you is mandatory so that the data controller can provide the required services/ products.
Notification of data to third parties:
Following inspections or checks (if requested of us), your data may be notified to all inspection and control bodies responsible for ensuring the correct fulfilment of legal requirements.
Your data may also be notified to companies/professional firms which provide assistance, advice or collaboration to the data controller, regarding accounting, administrative, fiscal, legal, tax and financial matters.
Your personal data are not disseminated in any way.
Your personal data will be stored for 10 (ten) years from termination of the service provision/product supply agreement.
Existence of an automated decision-making process:
There is no automated decision-making process.
Intention of the personal data processing Controller:
The Data Controller will not transfer your personal data to a third country or to an international organisation.

Art. 7 Legislative Decree 196/2003 and art. 15 of EU Regulation 679/2016 - Right of access to personal data and other rights -
The data subject is entitled to obtain confirmation of the existence or otherwise of personal data concerning it, even if not yet recorded, and their communication in intelligible form. The data subject is entitled to obtain the following information: the origin of the personal data; the purposes and methods of processing; the logic applied in case of processing with the aid of electronic media; the identification details of the data controller, the supervisor and the representative appointed pursuant to art. 5 sub-section 2; the entities or categories of entities to whom the personal data may be communicated or who are entitled to become aware of them as designated representative in the State territory, supervisors or appointed persons. The data subject has the right to obtain: the updating, amendment, or, if so required, the supplementing of data; the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those that do not need to be kept for the purposes for which the data were gathered or subsequently processed; certification that the operations referred to in letters a. and b. have been made clear, including as regards their content, to those to whom the data were communicated or disseminated, except in the case of such formality being impossible or involving the use of means manifestly disproportionate to the protected right. The data subject is entitled to oppose, in whole or in part, for legitimate reasons the processing of its personal data, even if pertinent to the purpose of gathering; the processing of its personal data for the purpose of sending advertising materials or direct selling or for carrying out market research or commercial communication.
In particular, the data subject may at any time ask the Data Controller to access its personal data and to amend or cancel these or limit the processing of its data or oppose their processing; the data subject is furthermore entitled to data portability. The data subject shall be entitled to withdraw its consent at any time without prejudice to the lawfulness of the processing based on the consent given prior to the withdrawal and shall be entitled to lodge a complaint with a supervisory authority.
